Online sports betting sites have grown into a massive business in the United States. But different regulations in states across the country affect the status of legal sports betting, depending on where you live.

More than six years have now passed since the Supreme Court first struck down the federal ban on sports betting in the landmark Murphy v. National Collegiate Athletic Association case in May 2018. Since then, a steady trickle of states have moved to legalize the industry, and more could follow in the years ahead.

North Carolina online sports betting launched in March of 2024. That means that roughly 40 states now allow some form of legalized sports betting, with close to 20 now boasting full online betting with multiple operators licensed to do business.

Most notably among the yet-to-legalize states, Missouri sports betting will go to a vote on Election Day in 2024 after years of deliberation in the legislative system. If passed, that industry could launch as soon as mid-2025. We could also see movement in states like Georgia, which has considered sports betting the past several years, and Nebraska, which currently has legal retail outlets but does not currently permit online sports betting.

Some brands, most notably FanDuel Sportsbook, Caesars Sportsbook, bet365 Sportsbook, and BetMGM Sportsbook, also rank among the country’s most popular sports betting sites. These brands offer sportsbook bonuses for new customers in legal states. Fanatics Sportsbook and ESPN BET are two of the biggest newcomers in the industry, opening in 2023.

Online sports betting is the practice of placing a wager on an upcoming or live sporting event, with the purpose of gaining money from its outcome. Both legal and illegal sports betting sites are currently active on the market.

Legal sports betting sites are based in America and covered by state laws and regulations. Customers are fully protected from fraud, theft or other undesirable practices.

Federal vs. state regulations

Since 2018 and Murphy v. NCAA, the regulation of sports betting became the responsibility of each individual state.

The Supreme Court ruled that existing laws against gambling commandeered power from the states to set their own regulations and ordered the overturning of the relevant legislation.

As a result, state and local governments are the only ones empowered with the decision of whether to legalize sports betting.

Federal laws

Federal laws like the Professional and Amateur Sports Protection Act (PASPA) once prohibited sports betting across most of the country. Its repeal in 2018 paved the way for individual states to establish their own sports betting laws.

State laws

As a result of that Supreme Court ruling, state governments are the primary authority charged with controlling sports betting.

This can lead to significant variation between jurisdictions: Texas residents cannot bet, for example, while they can in neighboring states such as Louisiana, Arkansas, New Mexico and Colorado. Curiously enough, America’s two most populated states, California and Texas, are among those which currently have no active initiative to legalize sports betting.

Laws can also vary depending on the type of establishment. Some states, for example, allow in-person betting while betting sites continue to be illegal.

The American Gaming Association maintains an interactive map which tracks where gambling is legal or otherwise, while also giving updates and projections on legalization initiatives.

An illegal sports betting site, on the other hand, has its headquarters offshore and is not cleared for use in the US. There are no safeguards in place for redress should a user fall victim to criminal activity, and any funds used gambling on such offshore sportsbooks could be liable to seizure from the authorities.

39 total states allow taking bets

Across the United States, 39 states permit some form of sports gambling.

In some states in-person betting is the only legal activity. This, however, generates significantly less revenue than full online betting.

States like New Jersey have sanctioned full online betting with multiple sportsbooks, with more than 20 operator cleared to take wagers.

In Oregon, Rhode Island and certain other states with a single authorized operator, meanwhile, just one sports betting site offers online services.

Arizona

The state of Arizona legalized online sports betting and in-stadium sportsbooks in a bill passed in April 2021. The first Arizona sportsbooks went live on September 9 of that year, coinciding with the start of the NFL season.

Arizona currently hosts 18 operators, including BetMGM, Caesars, and FanDuel, with space for two more.

In March 2022 Arizona became for the first time one of the top 10 states in monthly handle (the amount bet).

As well as online activity the state also offers in-person options: FanDuel and Caesars have opened in-person sportsbooks at the Footprint Center and Chase Field, respectively.

BetMGM is planning a sportsbook at State Farm Stadium, while DraftKings is expected to open a betting hub at a Scottsdale golf course hosting the Waste Management Open.

Arkansas

The Arkansas Joint Budget Committee finalized rules to expand online sports betting on February 22, 2022, having previously limited the practice to in-person play at three casinos.

The first online sportsbook was a collaboration between Southland Casino and Betly and went live on March 5 of that year.

BetSaracen, affiliated with Saracen Casino, launched approximately a month later, becoming the second online betting app in the state.

Arkansas’ law permits up to eight online sportsbooks, but major brands like DraftKings and FanDuel have been hesitant to join due to the requirement of partnering with a casino and sharing revenue.

Colorado

Colorado launched its first legal online and retail sports betting in May 2020, following a narrow approval by voters in the November 2019 election.

Since then, Colorado sports betting has developed into one of the most robust markets in the country, boasting 26 different apps, including major brands like DraftKings, FanDuel, and BetMGM.

Colorado was among the first states to surpass $200 million in monthly betting handle and in 2022, it ranked among the top 6 states in all-time betting dollars.

Online sportsbooks in Colorado must partner with one of the state’s 33 casinos to operate legally, which has allowed for the potential entry of even more apps into the market.

Colorado has one of the most operator-friendly setups nationwide, although lawmakers have begun tightening some loopholes due to low levels of tax revenue.

Connecticut

  • Current Legal Status: Legalized in 2021.

Connecticut Governor Ned Lamont made a deal with the Mashantucket Pequot and Mohegan tribes in May 2021, allowing them and the state lottery to operate online sports betting.

The providers partnered with DraftKings, FanDuel, and PlaySugarHouse, launching online betting on October 19, shortly after Connecticut began accepting in-person bets.

Each provider has in-person sportsbooks at least one casino, while the state lottery and Rush Street Interactive, owner of PlaySugarHouse, run seven retail locations with the potential to open up to 15 under state law.

As a smaller and newer market, Connecticut’s sports betting market is still developing. Its growth may be influenced by New York’s recent launch and Massachusetts’ current inability to legalize sports betting.

Delaware

  • Current Legal Status: Legal.

Delaware was among the pioneers of the new regulations, becoming the first state outside Nevada to accept a legal single-game sports bet on June 5, 2018 shortly after the Supreme Court’s decision.

Delaware’s sports betting market is run by the lottery and still prohibits online betting.

There are only three retail sportsbooks in the state, resulting in unimpressive revenue numbers.

Delaware’s small size, population, and the availability of digital sports betting options in neighboring states make it less significant despite its early start.

Florida

  • Current Legal Status: Legal.
  • Key Regulations: Run by the Seminole Tribe.
  • Popular Legal Sportsbooks and Betting Apps: Hard Rock Bet and Seminole-owned and operated casinos.

Florida enacted legislation to legalize sports betting in May 2021 as part of a compact negotiated between Governor Ron DeSantis and the Seminole Tribe.

This gave the Tribe exclusive rights to manage sports betting in the state, a decision which has led to legal challenges.

Online betting initially went live in November 2021 but was halted the following month after a federal judge ruled the agreement violated state and federal laws.

In October 2023 the US Supreme Court denied a petition from West Flagler to stop the Seminole Tribe from taking sports bets. This led to the Hard Rock online sports betting site being relaunched in November for existing users and new users in December, with the Seminoles pushing through the relaunch despite other pending legal challenges.

Illinois

  • Current Legal Status: Legalized in 2020.

Illinois launched in-person betting on March 9, 2020, and online betting in June 2020. It ranks among the top 5 states in both handle (dollars bet) and tax revenue due to its large population and strong sports interest.

A significant barrier was removed on March 5, 2022, when the in-person registration requirement was permanently lifted. Shortly after, BetMGM and Caesars joined the existing online sportsbooks in Illinois. Betting on in-state colleges was legalized in December 2021, but such bets must be placed in-person.

The industry got a bit more expensive for operators in 2024. That’s when the state implemented a new structure that will tax operators at a rate of up to 40%.

Indiana

Indiana launched online sports betting on Oct. 3, 2019, shortly after introducing in-person bets. It became the 13th state to legalize sports betting, with Governor Eric Holcomb signing the bill in May 2019.

Indiana sports betting has seen significant success since legalizing, accumulating over $7 billion in bets, ranking fifth among all states.

The state’s law permits over 40 online sportsbooks, but currently only 13 are operational.Major players like FanDuel and DraftKings have dominated the market, with four more expected to join soon.

Iowa

The state boasts over a dozen online sportsbooks, facilitated by relatively low licensing fees of $45,000 for the first year and $10,000 annually thereafter. Iowa is one of 10 states to have cleared bet365 to operate so far, as the global betting giants expand their presence in the U.S.

Iowa sports betting witnessed a significant increase in monthly handle in 2021 after the expiration of an in-person registration requirement. Despite its smaller population and lack of professional sports teams, Iowa’s per capita market is lucrative, benefiting from its proximity to neighboring states where sports betting remains illegal.

Kansas

Kansas legalized sports betting in 2022, enacting the bill before neighboring Missouri in a legislative race.

Both online and in-person betting commenced on Sept. 1, making it one of the fastest launches among states and coinciding with the start of the 2022 NFL season.

Six online operators and two casinos were initially authorized to accept bets, with additional operators expected to join the market soon. The state law permits up to 12 online sportsbooks, although only nine have been licensed thus far, with two more casinos anticipated to enter the market in the near future.

Furthermore, casinos have the option to establish agreements with retail locations such as professional sports arenas to install and manage betting kiosks.

Kansas’ native tribes have the opportunity to revise their gaming compacts and collaborate with commercial operators to offer online betting, potentially leading to the introduction of more online sportsbooks in the state.

Kentucky

Kentucky came close to legalizing sports betting in 2022, but the effort failed at the last minute. Finally, in April 2023, HB 551 was passed, allowing for the legalization of sports betting.

In-person sports betting debuted on Sept. 7, followed by the launch of mobile sports betting on Sept. 28, marking the fastest turnaround time from legalization to launch compared to other states.

The legislation permits Kentucky’s nine racetracks to offer sports betting at their venues. Each racetrack has the opportunity to partner with up to three online operators, potentially resulting in a total of 27 Kentucky sports betting options.

Louisiana

In November 2020, voters in 55 of Louisiana’s 64 parishes approved legal sports betting, including major cities like New Orleans, Baton Rouge, and Lafayette.

In-person betting was first introduced in October 2021. Then, on January 28, 2022, six online sportsbooks launched, including FanDuel, DraftKings, and BetMGM, followed by WynnBet shortly after, bringing the total to seven online sportsbooks.

The state’s law permits up to 41 different Louisiana sports betting apps, indicating potential for significant growth in the state’s online betting market.

Louisiana stands out as one of the only Southeastern states to legalize online betting, giving it a competitive advantage as its market matures.

Maine

Maine legalized sports betting in 2022, becoming the first state to do so that year. However, it wasn’t until November 2023 that sports betting became operational in the state.

Currently, DraftKings and Caesars are the only two online sportsbooks live in Maine.

A bill signed by Gov. Janet Mills in April allows Maine’s four native tribes to collaborate with commercial operators to offer online sports betting.

Additionally, the Hollywood Casino Hotel & Raceway and the Oxford Casino Hotel, owned by Penn National and Churchill Downs respectively, can apply for licenses for in-person betting only.

Maryland

  • Current Legal Status: Legalized in 2021.

Maryland legalized sports betting during the 2020 election, with 67 percent of voters in favor of the measure. After a prolonged go-live period, Maryland operators launched fully on November 23, 2022. There was an unusual soft launch period on the first Monday, followed by a temporary shutdown on Tuesday, and a relaunch on Wednesday at 9 a.m. ET.

Maryland’s law permits up to 60 online sportsbooks and 30 retail sites. Seven online sportsbooks launched immediately, with three more going live in the following months and potentially another dozen by the next football season.

Massachusetts

Massachusetts passed a sports betting bill on Aug. 1, 2022. In-person sports betting launched on Jan. 31, with online sports betting following on March 10, 2023, ahead of the NCAA Tournament. Six Massachusetts sportsbooks went live at that point: DraftKings, FanDuel, BetMGM, WynnBet, Barstool, and Caesars.

The state began its licensing process in early December, which drew attention due to concerns about Barstool and its responsible gambling messaging. The final sports betting bill includes a 15% retail tax and a 20% online tax.

Betting on Massachusetts colleges is prohibited, except for tournaments with 4+ teams. Casinos are permitted to partner with two online operators each, while racetracks are allowed one online partner.

Michigan

  • Current Legal Status: Legalized in 2021.

Michigan launched in-person wagering at the MGM Grand Detroit on March 11, 2020. This was followed by online sportsbooks, including BetMGM and DraftKings, which launched in early 2021.Michigan currently has a total of 15 online sportsbooks, the maximum allowed under state law.

With a population of 7 million over the age of 21 and teams in every major-league sport, Michigan has quickly become one of the top betting states. Michigan sports betting regularly finishes among the top 10 in monthly handle and ranks 7th among states in dollars bet all-time, right behind Colorado.

Michigan is one of the few states where iGaming is legal. Despite competition from neighboring states like Ohio, Michigan’s operator-friendly rules are expected to keep it atop the leaders in sports betting for years to come.

Mississippi

Mississippi launched retail sports betting on Aug. 1, 2018. The state technically allows for mobile wagering, but bets can only be placed while inside a casino, limiting its market share. Despite being one of the few legal Southern betting states, Mississippi’s restrictive mobile betting regulations have hindered its growth. Retail sports betting was passed in 2017 as part of a fantasy sports bill, prior to the Supreme Court lifting the federal ban on sports betting.

Despite the introduction of several online betting bills, none have made it to a vote, reflecting the conservative stance of Mississippi’s politicians on gambling expansion. Expanding sports betting in Mississippi faces challenges due to deep-seated opposition to gambling among the state’s politicians, common in many Southern states.

Montana

Montana, akin to Mississippi, permits mobile wagering but restricts it to the property of retail locations. Intralot, a Greek company managing the state lottery, initiated sports betting operations in March 2020, monopolizing the market and hindering competitive pricing. Montana’s restricted betting options, coupled with its sparse population, contribute to its minor role in the broader U.S. sports betting market.

Nebraska

In November 2021, voters sanctioned three constitutional amendments sanctioning “games of chance” at Nebraska’s licensed horse tracks. A regulatory bill enabling retail sportsbooks was enacted into law, paving the way for the commencement of in-person sports betting at WarHorse Sportsbook, which opened in Omaha and Lincoln in 2022.

Online betting remains illegal, however, while in-person bets are restricted to just three casino sites in the state.

Nevada

Nevada is renowned for its in-person sports betting, having been granted an exception from the previous Federal legislation to take wagers as far back as 1949.

But the state has yet to fully embrace online wagering, requiring individuals to visit a casino to register in person before engaging in online betting. This requirement posed challenges during the initial stages of the COVID-19 pandemic when casino visits significantly declined. Despite its historical significance in American gaming, Nevada has slipped to the second-most lucrative sports betting state due to its limited online betting options. As more densely populated states with statewide mobile wagering capabilities launch their platforms, Nevada’s ranking in the sports betting market may continue to decline.

New Hampshire

New Hampshire introduced online wagering on Dec. 30, 2019, with DraftKings being the sole mobile operator in the state. While DraftKings dominates the mobile betting market, there are also a few retail betting locations established or planned.

Intralot, known for its operations in Montana and Washington D.C., is anticipated to launch its mobile product in partnership with the state lottery.

Betting on in-state colleges is prohibited in New Hampshire.Despite its restricted market, New Hampshire has seen moderate success, but its betting handle is expected to decrease following the launch of online betting in Massachusetts.

New Jersey

Known as “The Gold Standard” for legal sports betting, New Jersey has become a leader in the industry after bringing the sports gambling case to the Supreme Court. It was the third state to legalize sports betting and has since set numerous state records, thanks to its competitive and operator-friendly system.

Geofencing restrictions limit the GamBetDC app’s access to federal properties, posing challenges in the nation’s capital.

Capital One Arena hosts the city’s first retail sportsbook, offering mobile wagering within the stadium through Caesars.

BetMGM established a partnership with the Washington Nationals, opening its retail sportsbook near Nationals Park on Feb. 1, 2022, with mobile app availability within a two-block radius. Another operator, Handle 19, is preparing to enter the D.C. marketplace with a retail location.

Overall, D.C.’s sports betting revenue has been limited due to pricing disparities and issues with the GamBetDC app.

Four states to watch

Missouri

Missouri sports betting hasn’t passed, but it’s not for a lack of trying. Bills have been considered on an annual basis for the past several legislative sessions, but most have been stonewalled by Sen. Denny Hoskins and his allies, who believe VLT legislation should be lumped into sports betting bills.

There may be progress coming soon, though. A petition backed by the state’s major sports teams garnered enough signatures to ensure a ballot question in the November 2024 election. If it passes, Missouri sports betting could become a reality as early as mid-2025.

Alabama

Alabama’s HB 151 and HB 152, both related to sports betting, passed the state House in mid-February, advancing to the Senate for consideration. However, the Senate did not bring the Alabama sports betting bills to the floor for a vote, falling short by one vote. Consequently, there was no opportunity to add a ballot measure for voters to decide on sports betting in November.

The Poarch Band of Creek Indians (PCI), a major gaming stakeholder in Alabama, remains a significant hurdle to legalizing sports betting, as their approval may be necessary for any compromise.

Despite Alabama being one of the few states without a lottery, there is growing interest among some lawmakers in various forms of gambling, including sports betting, casinos, and a lottery. The potential benefits of a lottery, particularly in light of neighboring Georgia’s experience, are seen as significant, especially in supporting higher education initiatives.

Georgia

Georgia’s hopes for legalizing sports betting were dashed once again as a bill failed to advance in the final day of the legislative session. Earlier in 2024, the Georgia state Senate approved SB 386, but the bill did not receive discussion in the House before the session ended. Georgia sports betting bills have cleared the Senate multiple times in recent years, but none have made it through the House.

SB 386 was amended in the Senate to include a constitutional amendment, requiring approval from at least two-thirds of the House. Originally, the bill proposed making sports betting a lottery game, which would not have required a constitutional amendment.

Despite the setback, sports betting remains a possibility for the future, although it is considered an underdog for passage in 2025 due to ongoing hurdles.

Minnesota

Minnesota narrowly missed legalizing sports betting in both 2023 and 2024. Most recently, in 2024, four different Minnesota sports betting bills were introduced during the state’s annual legislative session.

Division among those bills made unity very difficult. Lawmakers said progress was made ahead of the session’s adjournment, but none of the four bills faced a final vote.

The landscape of legal online sports betting is dynamic, with more states considering legislation to regulate the industry. Progress can sometimes be slow, however, as supporters of the bills clash with other interest groups who may be against legalized sports betting.
